“Stash Cash Back – Win 100X Sweepstakes”

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN

The following promotion is intended for entrants in the United States only and shall be construed and evaluated according to the laws of the United States. Do not proceed to participate in this promotion if you are not a legal resident of the United States.

Further eligibility restrictions are contained in the official rules below.

1. ELIGIBILITY: The Stash Cash Back Sweepstakes (the “Sweepstakes”) is offered by Stash Cash Management LLC (“Stash”), an affiliate of Stash Financial, Inc. Sweepstakes is only open to legal residents of the 50 United States and the District of Columbia who are at least eighteen (18) years of age at the time of entry. Void in all U.S. territories and possessions where prohibited by law.  Tax-advantaged accounts (including Roth IRAs and Traditional IRAs) and UGMA/UTMA (Custodial accounts) are not eligible under this Sweepstakes. This Sweepstakes is governed by U.S. law and is subject to all applicable federal, state and local laws and regulations. Entrant must have Internet access in order to enter the Sweepstakes. Each entrant must be the rightful owner (or have authorized use) of the e-mail address identified in the entrant’s entry. Employees of Stash Financial, Inc. and each of its respective affiliates, subsidiaries, parents, servicers, advertising,  promotion and fulfillment agencies and members of the immediate family or household of each, are not eligible to participate. Immediate family member is defined as a parent, sibling or any person residing in same household as employee. Stash will be referred to herein as “Sponsor.”
2. PROMOTION PERIOD: Sweepstakes begins on December 10, 2018 at 12:00 PM (ET) and ends on December 20, 2018 at 11:59 PM (ET) (“Promotion Period”).
3. ENTRY: An entrant must have or download the Stash app on their mobile device or register on the website and follow the instructions in the Stash app to complete the Stash enrollment process (if they have not done so already). To receive one (1) entry in the Sweepstakes, entrant must complete at least one (1) qualified transaction as described in the the Stash Cash Back terms and conditions during the Promotion Period. Entrants first qualified transaction amount during the Promotion Period will count as the entrant’s one (1) entry into the Sweepstakes. Entrants may not receive more than one (1) entry for this Sweepstakes, thus multiple transactions utilizing linked eligible debit or credit cards, will not result in multiple entries for the entrant.  Sponsor is not responsible for incorrect data entry or other failure on the part of entrants to meet standards of an individual Stash account.
4. PRIZE/ODDS: Ten (10) Grand Prizes will be awarded over the Promotion Period; a Grand Prize consists of one-hundred times (100x) the cash back amount earned on the entrants first qualified transaction during the Promotion Period up to five-hundred dollars ($500).  For example, if an entrant’s first qualified transaction qualifies for 4% cash back at a participating Stash Cash Back merchant, the entrant will be entered to win one-hundred times (100x) the cash back amount earned for that qualified transaction, up to $500. The prize will be awarded in the form of cash back to be reflected in the entrant’s Stash Cash Back balance and ultimately deposited into the winner’s Stash Invest cash balance account. If, at the relevant time of payment of prize funds, the selected winner does not have a Stash account that is open and in good standing, the prize will be awarded in the form of a check. ALL EXPENSES, TAXES AND COSTS ASSOCIATED WITH ACCEPTANCE AND USE OF PRIZE NOT SET FORTH IN THESE RULES IS THE OBLIGATION OF THE WINNER. Prize is not transferable, except at discretion of Sponsor. Prize is awarded WITHOUT WARRANTY OF ANY KIND from Sponsor, express or implied, without limitation. The Total Approximate Retail value of all prizes is up to $5,000. The odds of winning the prize will depend on the number of eligible entries received throughout the Promotion Period.
5. DRAWING: Random drawings will take place once per day on the following dates:

The potential winners will be selected at random from all eligible entries received. All non-winning eligible entries from the previous Entry Period drawings will carry over to subsequent Entry Period drawings.  The potential winners will be notified by Sponsor or Sponsor’s designee by email, telephone, or regular mail within approximately ten (10) days of the drawing. If Sponsor or Sponsor’s designee is unable to contact a potential winner after reasonable effort, or if a potential winner fails to respond within three (3) business days of first attempted notification, prize may be forfeited and awarded to an alternate winner.

1. Alternative Method of Entry by Mail: To receive one (1) entry without completing a qualified transaction at a participating Stash Cash Back merchant, entrant must submit their name, address, email and phone number using this survey form. Limit of one (1) survey entry requests per person. All entries must be submitted by December 20, 2018 at 11:59 PM  (ET).
2. Limit one (1) entry per person using only one (1) Stash account during the Promotion Period, regardless of method of entry. No purchase required to enter or win. No responsibility is assumed by Sponsor for lost, late, misdirected, illegible, incomplete, stolen, or mutilated entries or investment transactions or for any computer, online, telephone or  technical malfunctions that may occur. Sponsor may reject any entry it believes is the result of fraud or were submitted in violation of the official rules. In the event that you have won a Sweepstake prize from Sponsor within the last 12 months, you will not be eligible to receive a prize from this Sweepstake promotion.
3. GENERAL: In Stash’s sole discretion, the potential winner may be required to sign and return to Stash or Stash’s designee a notarized Affidavit of Eligibility, a Liability Release, a W-9 Form, and, where legal, a Publicity Release, within ten (10) days of first attempted notification. If the foregoing is required by Stash and in the event of noncompliance by the potential winner, the potential winner may be disqualified and an alternate winner selected, at Stash’s sole discretion. By entering, participants (a) agree to be bound by the official rules and the decisions of Stash (including but not limited to eligibility determinations) which are final and legally binding in all respects; (b) agree to release Sponsor and and all of its affiliates  and each of their employees and agents from any and all liability, loss, damage or injury resulting from participation in this Sweepstakes or awarding, receipt, possession use and/or misuse of any prize awarded herein and acknowledge that Sponsor and their employees and agents have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize including, but not limited to, its quality, mechanical condition or fitness for a particular purpose; (c) consent to use of his/her name, photograph and/or likeness for advertising and promotional purposes in connection with this Sweepstakes without additional compensation, unless prohibited by law; (d) agrees that Sponsor may share his or her entry information, including the information contained on the Registration Form, with Sponsor and (e) agree to Sponsor’s use of entrant’s personal information as described in its privacy policy at https://www.stashinvest.com/theprivacypolicy.
4. INTERNET: If, for any reason, this Sweepstakes is not capable of running as planned, whether due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupts or affects the administration, security, fairness, integrity, or proper conduct of this  Sweepstakes, Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes. In the event of termination, a random drawing to award the prize will be conducted from all eligible entries received up until the time of termination. Neither Sponsor nor any of its affiliates assume any responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Neither Sponsor nor any of its affiliates is responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers,  computer equipment, software, failure of any e-mail, investment transaction or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute, entries will be declared made by the authorized account holder of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
5. DISPUTES: This Sweepstakes is governed by the laws of the United States and the State of New York, without respect to conflict of law doctrines. As a condition of participating in this Sweepstakes, entrants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in New York having jurisdiction. Further, in any such dispute, under no circumstances will entrants be permitted to obtain awards for, and hereby waive all rights to   claim punitive, incidental or consequential damages, including attorneys’ fees, other than entrant’s actual out-of-pocket expenses (e.g. costs associated with entering), and entrant further waives all rights to have damages multiplied or increased
6. PUBLICITY: By accepting a prize, you grant to Sponsor the right, except where prohibited by law, to use your name, likeness, picture, address (city and state), e-mail address, voice, biographical information and written or oral statements, for advertising and promotional purposes in promoting or publicizing Sponsor and its affiliates and their respective products or services, without compensation unless required by law. You shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of your name, picture, likeness, address (city and state), email address, biographical information, or entry. The rights granted under this paragraph shall extend to submissions and all other submitted materials related to the Sweepstakes, including those submitted by non-winners and winners.
